This Acceptable Use Policy ("AUP") outlines the rules and guidelines that govern the use of Deltaworx's services, including but not limited to cloud computing, web hosting, domain registration, servers, and web development services. By using our services, you agree to comply with this policy.
You agree not to use our services to:
- Violate any applicable laws, regulations, or ordinances
- Infringe upon the legal rights of others, including intellectual property rights
- Engage in activities that are harmful, threatening, abusive, or harassing
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- Interfere with or disrupt our services or servers or networks connected to our services
- Circumvent user authentication or security of any host, network, or account
You agree not to store, distribute, or transmit any content that:
- Is illegal, harmful, threatening, defamatory, obscene, or otherwise objectionable
- Facilitates illegal activity
- Depicts sexually explicit images
- Promotes illegal violence
- Is discriminatory based on race, gender, color, religious belief, sexual orientation, disability, or any other legally protected category
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
- Contains malware, viruses, corrupted files, or any other similar software or programs that may damage the operation of our services or others' computers
The following actions are strictly forbidden:
- Running any nmap port scans
- Using Deltaworx services to create, host, or distribute malicious software (including viruses, worms, Trojans), to launch denial-of-service attacks, or to engage in mail bombing or flooding.
- Running proxy scripts, IRC services, including commercial scripts with known vulnerabilities; chat rooms, IRC bots, torrent trackers, top sites, or online games (except small browser-based games).
- Collecting or processing personal information for illicit purposes.
- Unauthorized access to data, systems, or networks (including phishing, spoofing, hacking, sniffing, or proxying), as well as probing, scanning, or testing vulnerabilities without explicit authorization.
- Any interference with services provided to another customer or server, such as deliberate overloading, mail bombing, or flooding.
- Falsification of TCP/IP packets.
- Uploading viruses, corrupted files, or other harmful applications.
- Restricting, preventing, or interfering with another user’s ability to use Deltaworx services.
- Collecting third-party data or email addresses without consent.
Any attempt to damage Deltaworx servers or other customers is strictly prohibited. Any activity affecting the performance, stability, or security of our network will be considered abuse.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our Terms of Service or this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice.
- You may not knowingly send or permit unsolicited communications (any email-based messages sent without the recipient’s consent). Doing so is grounds for immediate termination and a permanent ban from all future services.
- Each email account will be limited to 600 outbound emails per hour unless a prior agreement has been reached. You may not create additional email accounts for the sole purpose of extending that limit.
- You are required to have valid SPF, MX and DKIM records on domains that send through our service. Failure to do so results in reduced sending reputation for your domain and our IP addresses, which can result in us parting ways to ensure high quality sending for our other customers. The SPF, MX and DKIM records are available in the client area under your service.
You agree not to use our services to send unsolicited mass emails (spam). This includes, but is not limited to:
- Sending unsolicited marketing messages or communications
- Sending messages to recipients who have opted out of receiving messages from you
- Using purchased or rented email lists for marketing purposes without proper consent
- Sending bulk emails through third-party services that fail to secure proper consent from recipients
- Sending emails with deceptive subject lines or falsified headers
You may not:
- Run any crypto mining operations on our servers.
- Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our servers.
- Participate in any file-sharing/peer-to-peer activities
- Run any gaming servers such as Minecraft, counter-strike, half-life, battlefield1942, etc.
- Using excessive CPU time, memory, or storage
- Running applications that are excessively memory-intensive or significantly impact the performance of our systems
- Running any type of web spider or indexer, without prior written authorization
- Using excessive bandwidth relative to your subscription plan
- Bandwidth is measured as the total data transfer to and from your hosting account
- Each plan includes a specific bandwidth allocation
- Exceeding bandwidth limits may result in additional charges or service suspension
- Bandwidth cannot be carried over from month to month
Deltaworx reserves the right to limit bandwidth for activities that negatively impact server performance
Your Services may be terminated with or without notice upon any violation of this AUP. If applicable, violations will be reported to the appropriate law enforcement agency.
A failure to respond to an email from our abuse department within forty-eight (48) hours, or as otherwise specified in the email, may result in the suspension or termination of your Services. All abuse issues must be dealt with via trouble ticket/email and will receive a response within forty-eight (48) hours.
