Your use of the Service depends on accepting and following these Terms. They apply to all visitors and users and include any referenced policies or applicable laws. By using the Service, you agree to all conditions, rules, and procedures published by the Company or its third-party providers.
Some parts of the Service may have additional terms, which also apply. If you do not agree to these Terms, you may not access or use the Service.
By using our services, you agree to:
- Provide accurate, current, and complete information about yourself and your organization when registering
- Maintain and promptly update your registration information to keep it accurate, current, and complete
- Be responsible for keeping your account credentials secure
- Be fully responsible for all activities that occur under your account
- Notify Deltaworx immediately of any unauthorized use of your account
- Ensure that all users of your account comply with these Terms
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
All orders placed with Deltaworx are subject to manual verification to ensure compliance with our security standards and to prevent fraudulent activities.
Customers are required to provide complete and valid contact information during the order process. This information is essential for accounting purposes and to maintain effective communication. All anonymous orders would be rejected.
Depending on various risk factors, certain orders may be subject to additional identity verification procedures, commonly known as Know Your Customer (KYC) checks. These measures are implemented to verify the identity of our customers and to comply with legal and regulatory requirements.
- All payments are due in advance of service delivery
- Services may be suspended if payment is not received by the due date
- For recurring services, you authorize Deltaworx to bill your payment method on a recurring basis
- You are responsible for updating your payment information
- Deltaworx may suspend or terminate services for non-payment
If you believe there's an error in billing, you must notify us within 30 days of the charge.
Payments can be made directly via PayPal, Orange Money, MyZaka, or by Bank transfer / EFT to the Deltaworx bank account. Bank details will be provided on the invoice.
Card transactions are processed by an external payment gateway, which securely stores and handles all card-based payments. No card details are stored on the Deltaworx website.
By the Account Activation Date of each month, Deltaworx shall:
- Deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month.
- When an invoice is delivered to the client, payment shall be remitted to Deltaworx by no later than the specified payment due date. Deltaworx shall be entitled to immediately terminate this agreement for client's failure to make timely payments.
- You will be provided with an invoice on a monthly / quarterly / semi-annual or annual basis, 7 days prior the actual due date, unless otherwise specified. Payment delays should be explained via a ticket, to avoid service suspend/terminate.
Our refund policy is as follows:
- Our Linux VPS, Windows VPS, Web Hosting and Cloud Storage services come with a 3-day money-back guarantee
- Domain registrations are non-refundable
- Renewal charges are not eligible for refunds
- To cancel your service, you must submit a cancellation request through the Client Zone
- For monthly billing cycles, the cancellation must be received before the next billing cycle
- We do not refund cancelled services. For example, if your service is for a month and you cancel after two weeks, no refunds will be given
You acknowledge and agree that:
Your use of this Site and the Services found at this Site, including any content you submit, will comply with these Terms of Services and all applicable local, state, national and international laws, rules and regulations.
You will not use this Site or the Services found at this Site in a manner that:
- Is illegal, or promotes or encourages illegal activity;
- Promotes, encourages or engages in child pornography or the exploitation of children;
- Promotes, encourages or engages terrorism, violence against people, animals, or property;
- Promotes, encourages or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking;
- Violates legislation, or promotes, encourages or engages in the sale or distribution of prescription medication without a valid prescription;
- Infringes on the intellectual property rights of another User or any other person or entity;
- Violates the privacy or publicity rights of another User or any other person or entity, or breaches any duty of confidentiality that you owe to another User or any other person or entity;
- Interferes with the operation of this Site or the Services found at this Site;
- Contains or installs any viruses, worms, bugs, Trojan horses or other code, files or programs designed to, or capable of, disrupting, damaging or limiting the functionality of any software or hardware;
- You will not copy or distribute in any medium any part of this Site or the Services found at this Site, except where expressly authorized by Deltaworx.
- You will not modify or alter any part of this Site or the Services found at this Site or any of its related technologies.
While Deltaworx maintains regular backup procedures, we cannot guarantee the availability of backups or the integrity of data in all circumstances:
- You are solely responsible for maintaining independent backups of your content
- Deltaworx backups are primarily for disaster recovery purposes
- Backup schedules and retention policies vary by service plan
- Backup restoration may incur additional fees
- Deltaworx is not liable for any loss of data regardless of the cause
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and cancel through your control panel.
Deltaworx cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain equipment, routing, software and programming used by Deltaworx are not directly owned or written by Deltaworx. Moreover, Deltaworx holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Deltaworx sees fit.
